Employment Law Update

Recent media speculation has suggested that the Federal Government is to confirm a review of employment and industrial relations legislation. While pre election promises indicated no sweeping reforms would be made to Australian industrial relation laws it does appear that a Productivity Commission inquiry into the Fair Work Act will be announced to will examine the impact the Act has on unemployment and under-employment, productivity, business investment and the ability of the labour market to respond to changing economic conditions. While the scope of the inquiry is suggested to be quite broad it is still far too early to suggest that the Coalition Government will attempt to return to similar policy to the failed WorkChoices. Employers and employees will need to watch this space as the Government's inquiry, and any recommendation from it, may take at least 18 months to result in amendment to the Act.
