You and your lawyer: Part 3 – Working with your lawyer

Posted on 08 November 2012

In part one of our series of “You and your Lawyer” we referred to the advice of Mark Bouris, urging a struggling new business owner to ensure he maintained a good partnership with professional people to assist and guide him with his start-up business. Mark believes business owners can partner with their lawyer and use them as mentors and unemotional heads to guide them during the ups and downs.

One of the best ways you can partner with your lawyer is to actually work with them before problems arise. Think of them as you legal Navman. You are on a journey and they are there to guide you through the legal mine field which can rule and ruin if you do not follow the correct roads. Get to know your Lawyer early on as this way, you get to meet and understand what your lawyer can do for you in an environment which is not already stressful, urgent and costly. They can share with you a raft of proactive suggestions from experience they have had with similar businesses which can now benefit you. Your lawyer can be a knowledgeable mentor who, as your firm grows, can assist you to implement the growth strategies you discussed early on in the business journey. This path can also save huge sums of money as you are investing in legal advice which is designed to assist you in a proactive, knowledge driven manner to avoid problems rather than having to pay huge legal bills to get you out of trouble through either poor practice or lack of knowledge.

Here are a few areas which your lawyer can assist you with:

  • Employment contracts
  • Contract advice
  • Terms and conditions
  • Intellectual property
  • Commercial leasing
  • Sale and purchase of business
  • Sale and purchase of property
  • Litigation

Many famous statesman have used a variation on this saying:

If you fail to plan, you plan to fail.
