The National Privacy Principals (NPPs) located at www.privacy.gov.au/npp govern our collection, use and disclosure of personal information. 3. Your personal information is stored by us in electronic and hard copy files. This information is used by us in our capacity as your legal representatives and you agree for this information to be provided to barristers, experts, Courts, accountants, medical practitioners and others involved in the provision of our legal services to you. In addition to collecting information directly from you we also collect information from third parties, including through subpoenas (Summons to Produce), interviews with witnesses, witness statements, credit checks with Baycorp Advantage (formerly CRAA), searches with SAIC, ABR, OFT and other sources. External services providers, such as IT consultants have access to electronic information retained by us. Much of the information held on our files is retained for at least seven years. If you specifically require information to be destroyed you need to let us know in writing by identifying the particular information and the reason why destruction is necessary. Access will not be granted unless sufficient information is provided to us to ensure that you are the individual that the personal information relates to. Access will usually not occur until at least one month has passed from the date that an original, signed, dated written request for access containing sufficient personally identifying information has been provided. 7. The Legal Profession Act requires us to obtain certain information from you. It also requires us to disclose certain information to you. We may also have to obtain information from you to comply with other laws including tax laws. Amongst other things, we need sufficient information from you to ensure that we are providing you with independent advice and that no conflict of interest arises. If you do not provide us with all of the information that we need then we will not be able to provide you with legal services. 8. Client privilege (legal professional privilege) applies to information provided to us by clients for the dominant purpose of legal advice or a legal issue. 9. If you do not want to receive direct marketing communications from us please let us know in a written document that sufficiently identifies you and your specific request not to receive direct marketing communications. 10. Internet use of our website may lead to your personal information being retained by us via the use of cookies, web bugs or other means. 12. If you fail to pay our account(s) for any reason (including if a dispute exists) we may make a report to Baycorp Advantage. We endeavour to operate in accordance with the Best Practice requirements for information management laid down by the Privacy Commissioner. We respect your right to privacy and we acknowledge the trust that you have placed in Us. The Privacy Commissioner has never had any reason to be concerned about our management of information and we would like to keep it that way.
